1. Agreement to Terms

Welcome to Trendly. These Terms of Service ("Terms") govern your access to and use of the Trendly website at trendly.art and our AI image generation services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 16 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under any applicable laws
• Your use of the Service will not violate any applicable law or regulation

3. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate your account if any information provided is inaccurate, incomplete, or violates these Terms.

4. Service Description

Trendly provides an AI-powered image generation platform that allows users to:

• Upload photos for AI processing
• Generate AI-enhanced or AI-created images using templates
• Download and share generated content
• Manage uploads and generation history

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

5. Subscription and Payments

Payment Processing

Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides all customer service inquiries and handles returns.

When you make a purchase, you agree to Lemon Squeezy's Terms of Service and Lemon Squeezy's Privacy Policy.

Subscription Plans

We offer various subscription plans with different features and credit allocations:

• Free: 5 one-time credits, basic features, 30-day storage
• Starter: 100 credits/month, 1080p downloads, 90-day storage
• Pro: 300 credits/month, 4K downloads, 1-year storage, no watermark
• Max: 1,000 credits/month, unlimited storage, API access

Credit System

Credits are the currency used to generate images on Trendly. Each template has a specific credit cost. Credits from subscriptions are allocated monthly and do not roll over. Purchased credit packs do not expire as long as your account remains active.

Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You can cancel your subscription at any time through your account settings or via Lemon Squeezy's customer portal. Cancellation takes effect at the end of the current billing period.

Refunds

Refund requests are handled by Lemon Squeezy in accordance with their refund policy. For refund inquiries, please contact Lemon Squeezy support or see our Refund Policy.

6. User Content

Your Content

You retain ownership of any photos you upload to the Service ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing the Service to you.

Generated Content

Images generated through the Service ("Generated Content") are owned by you, subject to:

• Your compliance with these Terms
• Any rights retained by third-party AI providers
• Applicable laws regarding AI-generated content

Content Restrictions

You agree not to upload, generate, or share content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains nudity, pornography, or sexually explicit material
• Depicts minors in any inappropriate context
• Infringes on intellectual property rights of others
• Contains personal information of others without consent
• Is deceptive, fraudulent, or misleading (including deepfakes intended to deceive)
• Promotes violence, discrimination, or hatred
• Violates any applicable law or regulation

We reserve the right to remove any content that violates these Terms and to terminate accounts of repeat violators.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Circumvent any usage limits, rate limits, or access controls
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) without authorization
• Resell, redistribute, or sublicense the Service without permission
• Use the Service to train competing AI models
• Impersonate any person or entity
• Engage in any activity that could damage our reputation

8. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Trendly and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

"Trendly" and our logo are trademarks of Trendly. You may not use our trademarks without prior written consent.

9. Third-Party Services

The Service integrates with and relies on third-party services, including:

• Lemon Squeezy: Payment processing
• AI Providers: Image generation capabilities
• Cloud Services: Data storage and hosting

Your use of these third-party services may be subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any content or results
• Warranties that generated content will meet your requirements or expectations

AI-generated content may contain errors, inaccuracies, or unexpected results. You are responsible for reviewing and verifying any content before use.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDLY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your account or data
• Damages arising from third-party services or content

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Trendly and its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content or Generated Content
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of any applicable laws

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

You may delete your account at any time through your profile settings. Account deletion will result in the permanent removal of your data in accordance with our Privacy Policy.

14. Data Retention

Generated images and uploaded photos are retained according to your subscription plan:

• Free: 30 days
• Starter: 90 days
• Pro: 1 year
• Max: Unlimited (while subscription is active)

We will send you a notification before your content expires. Download any content you wish to keep before the retention period ends.

15. Dispute Resolution

Any disputes arising from or related to these Terms or the Service shall be resolved as follows:

• First, attempt to resolve the dispute informally by contacting us at support@trendly.art
• If informal resolution fails, disputes shall be resolved through binding arbitration
• Class action lawsuits and class-wide arbitrations are not permitted

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of competent jurisdiction.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes

Your continued use of the Service after changes indicates acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trendly regarding the Service. These Terms supersede any prior agreements or understandings.
