Terms of Use & End User License Agreement — Trendly

I. Acceptance of Terms

These Terms of Use and End User License Agreement ("Agreement") constitute a legally binding agreement between you ("user," "you") and Juicyapps LLC("we," "us," "our") governing your access to and use of the "Trendly" mobile application and the trendly.art website (collectively, the "Service").

By downloading, installing, or using the Service you confirm that you have read, understood, and accepted this Agreement. If you do not agree, do not install or use the Service, or delete it from your device.

II. Modifications

We may update this Agreement at any time. Updates are effective upon posting. Your continued use of the Service after an update constitutes acceptance of the revised Agreement. We recommend reviewing this page periodically.

III. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service independently. Users aged 13–17 may use the Service only with verifiable parental consent and under direct parental supervision.

Any person under the age of 13 is strictly prohibited from downloading, installing, or using the Service.

The portrait and avatar generation features are restricted to users who have reached the age of majority in their jurisdiction. We will terminate access for any minor found to have used these features in violation of this section.

IV. Description of the Service

Trendly is a creative AI-powered platform available as a mobile application (iOS) and web application (trendly.art) for generating images and videos from text, photo, or video prompts. It offers trending templates, custom AI generation studio, style filters, avatar creation, video studio, and related features.

Your user account, credit balance, and subscription status are shared between the mobile application and the web application when you sign in with the same account (Apple, Google, or email).

V. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect and process your personal data. By using the Service you accept the Privacy Policy. Please read it carefully at: https://sites.google.com/view/privacy-policy-trendly

VI. License and User Content

App License

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes.

All intellectual property in the Service — including source code, UI/UX design, graphics, audio, and trademarks — belongs to Juicyapps LLC or its licensors and is protected by applicable law. You may not copy, reproduce, modify, distribute, or reverse-engineer any part of the Service.

Your Content

You retain all rights to Input Content and Output Content you create ("User Content"). We do not claim ownership of your User Content.

By using the Service, you grant us a limited, temporary, royalty-free, worldwide license to process your User Content solely to provide the requested features, improve generation quality, and use anonymized examples to demonstrate Service capabilities to other users. We do not use your User Content for any other purpose.

You may use Output Content for personal or commercial purposes, including reproduction, distribution, and sale.

Input Content Requirements

Before submitting Input Content you confirm that:

• You own it or have all necessary rights and permissions to use it as described.
• It does not infringe any third party's copyright, trademark, or privacy rights.
• You have obtained the consent of any individual depicted in the content.
• It does not contain child photos, images, or likenesses.
• It does not include copyrighted or trademarked materials without authorization.

Third-Party AI Technologies

The Service uses third-party AI providers to power generation features, including but not limited to:

• OpenAI (GPT-4o Image)
• Google (Veo, Imagen, Gemini)
• Runway AI, Inc.
• Black Forest Labs (Flux)
• Kling AI
• ByteDance (Seedream, Seedance)
• Anthropic (Claude, for prompt generation)

By using AI-based features you accept the respective service terms of these providers. The specific providers used may change as we add or update models.

VII. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Exploit, harm, or attempt to harm minors in any way.
• Generate or spread false, misleading, defamatory, or hateful content.
• Create content that discriminates against individuals or groups based on race, gender, religion, nationality, sexual orientation, disability, age, or other protected characteristics.
• Infringe any third party's intellectual property, privacy, or other rights.
• Upload content that is pornographic, obscene, or otherwise offensive.
• Introduce malicious code, viruses, or other harmful software.
• Attempt to reverse-engineer, decompile, or tamper with the Service.
• Sublicense, sell, rent, or otherwise transfer access to the Service to third parties.

Violation of these rules may result in immediate termination of your access and potential legal action.

VIII. Availability and Disclaimers

The mobile application requires iOS 16.0 or later and an active internet connection. The web application requires a modern web browser. We do not guarantee uninterrupted, error-free access, and we may update or suspend the Service at any time.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.

IX. Subscriptions, Credits, and Purchases

The Service is free to download. Certain premium features require credits, which can be obtained through subscriptions or one-time purchases.

Credit System

• Credits are the internal currency used to generate AI content.
• Different generation types cost different amounts of credits, displayed before each generation.
• Credits purchased via credit packs do not expire.
• Credits allocated with a subscription may expire at the end of the billing period.

Subscriptions

• Subscription plans are available on a weekly or annual basis (prices shown at checkout in your local currency and may vary by country).
• Weekly subscription includes 120 credits per billing period.
• Annual subscription includes 1,000 credits per billing period.
• A free trial may be offered; any unused portion is forfeited upon purchase of a subscription.
• Subscriptions auto-renew within 24 hours before the end of each billing period unless cancelled at least 24 hours in advance via your Apple ID Account Settings (iOS) or your account settings on trendly.art (web).
• Payment is charged to your Apple ID Account upon confirmation of purchase.
• Removing the App from your device does not cancel your subscription.

Credit Packs

• One-time, non-renewable credit pack purchases are available in various sizes (e.g., 25, 100, 300 credits).
• Credit pack credits do not expire and are added to your account balance.
• Credit packs are non-refundable once used.

User Account and Cross-Platform Access

We recommend signing in with Apple or Google to protect your purchases. Credits and subscription status are linked to your user account and available across platforms (mobile and web) when signed in with the same account.

Credits purchased while using an anonymous (guest) session are linked only to that session. If you sign in to an existing account, credits from the anonymous session may be transferred to your signed-in account.

Restoring purchases on iOS will restore your subscription status. To restore your credit balance, sign in with the account that was active at the time of purchase.

X. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JUICYAPPS LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR USER CONTENT.

XI. Governing Law

This Agreement is governed by the laws of the Republic of Armenia, without regard to conflict of law principles. Any disputes shall be resolved in competent courts of Armenia, unless otherwise required by applicable consumer protection law.
